Some of the luminaires shown on www.next.design can be purchased online. The following general terms and conditions apply to these luminaires. All luminaires not available for purchase on www.next.design are available from one of our specialist dealers.

2. basis and subject matter of the contract
a) The following General Terms and Conditions govern the contractual conditions between less'n'more GmbH (hereinafter referred to as less'n'more) and you as a customer (consumer and entrepreneur) of the online shop www.next.design . These General Terms and Conditions apply exclusively to the ordering of products in the online shop www.next.design. Other general terms and conditions, in particular the terms and conditions of customers, are not included in the contractual relationship with the customer, even if less'n'more does not expressly object to any inclusion.
b) The General Terms and Conditions shall apply in the version valid at the time of conclusion of the contract. They shall apply exclusively to contracts concluded using exclusively means of distance communication via the online shop www.next.design.
c) The subject of the contract is the offer of the products of the online shop www.next.design as well as the delivery to you.
d) Goods shall only be handed over in quantities customary in the trade.
3 Offer, order, conclusion of the contract
a) Information in "www.next.design" does not constitute binding offers in the legal sense.
b) You can view all products in detail on www.next.design before ordering. You start the ordering process by selecting the desired quantity to the right of the image of the desired product and adding the product to the shopping cart by clicking the "add to cart" button. The product is now in the shopping cart in the desired quantity. By clicking on the "shopping cart" icon at the top right, you can view or change your current selection and number of products at any time. The unit price, the VAT included and the total price are displayed.
c) Click on the button "Checkout" to continue the ordering process. We now need your personal details as well as your billing and delivery address. You will then receive information about the delivery and can select the desired method of payment (see point 4 below).
d) Before completing the order process, the following information will be displayed again as an overview:
- Links to these T&Cs associated with the request to confirm your agreement. You can save these GTC in reproducible form.
- Name, delivery address, billing address and desired payment method
- desired number of products, unit price, shipping costs, included VAT and total price
e) In each phase of the ordering process up to its completion (see 3. f) below), you can go back and forth within the ordering process at any time by clicking on the "back" and "continue" buttons and check and, if necessary, change your entries and the contents of the shopping cart.
f) Under the order overview (see above 3. d) there is a button "order subject to payment". By pressing this button, you declare bindingly that you wish to purchase the ordered products at the total price stated and thus submit a binding offer.
g) After submitting the order, you will receive a confirmation of receipt by e-mail to the e-mail address you provided. The confirmation of receipt contains the order data, the cancellation policy and these GTC. The confirmation of receipt does not constitute a contract. The confirmation of receipt merely documents that the order has been received by less'n'more.
h) A contract is only concluded when the ordered products are handed over to the shipping service provider.
i) Only the German language is available for the conclusion of the contract.
j) The text of the contract is not stored by less'n'more after the conclusion of the contract and can no longer be retrieved by you after the conclusion of the contract. However, the order data is contained in the confirmation of receipt by e-mail (see lit. g above), which can be saved and printed out.
4. prices and payment
a) The prices stated in the online shop www.next.design are in euros (€) and include the statutory value added tax plus any costs for shipping. The prices apply exclusively to orders placed in the online shop www.next.design
b) You can choose from the following payment options:
Payment via PayPal
If you pay by PayPal, the payment will be made during the order process, provided you have a PayPal account. Receipt of payment by less'n'more takes place immediately after completion of the order. The goods will be delivered after receipt of payment.
Payment by credit card
Accepted cards: VISA, MasterCard.
The debit will be made by less'n'more GmbH. The credit card will be charged immediately after completion of the order. The processing is carried out by Stripe Inc. 510 Townsend Street, San Francisco, CA 94103, USA (payment provider).
Payment by invoice and financing
In cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer purchase on account and hire purchase as a payment option. Please note that purchase on account and instalment purchase are only available to consumers and that payment must be made to Klarna in each case. The use of these payment methods also requires a positive credit check.

Invoice with Klarna
The payment period is 14 days from the dispatch of the goods/ticket/ or, in the case of other services, the provision of the service. You can find the invoice conditions here. -
Instalment purchase with Klarna
With Klarna's financing service, you can pay for your purchase flexibly in monthly instalments of at least 1/24 of the total amount (but at least EUR 6.95) or under the conditions otherwise specified in the checkout. The instalment payment is due at the end of each month after Klarna sends you a monthly invoice. Data protection when choosing Klarna as a payment method
Klarna checks and evaluates your data and exchanges data with other companies and credit agencies where there is a legitimate interest and reason to do so. Your personal information will be treated in accordance with applicable data protection laws and as set out in Klarna's Privacy Policy.
5 Delivery, shipping costs
a) We deliver within a maximum of 3 weeks from receipt of the order. In the event of a delay in delivery, we will inform you immediately. To keep shipping costs as low as possible, we will ship your order in as few shipments as possible. The shipping service provider is usually UPS.
b) In the event that the ordered products are not available, we will not accept your contractual offer (cf. 3. f) above). In this case, we will inform you immediately and refund any payments already received without delay.
c) You will receive information about the shipping costs if you click on the link "plus shipping costs" behind the price information for the respective goods. Within Germany, we deliver free of shipping costs for orders placed via our online store.
6. right of withdrawal
As a consumer (a natural person who places the order for a purpose that can be attributed neither to his commercial nor to his independent professional activity), you have the following statutory right of withdrawal:

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods.

by means of a clear declaration (e.g. a letter sent by post, fax or e-mail) of your decision to revoke this contract. You can use the model withdrawal form for this purpose, which is, however, not mandatory. To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
Consequences of revocation
If you withdraw from this contract, we must return to you all payments that we have received from you, including the delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days of the day on which the notification of your withdrawal from this contract was received by us, unless expressly agreed otherwise with you; in no case will you be charged for this repayment.
You must return or hand over the goods to us (less'n'more GmbH, Scheidtweilerstr.79, D-50933 Cologne) without delay and in any case no later than fourteen days from the day on which you notify us of the revocation of this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days. You shall bear the direct costs of returning the goods.
You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking the quality, characteristics and functioning of the goods. This is also the case, for example, if the original packaging is missing.
End of the cancellation policy
7 Warranty, limitation of liability
a) The statutory provisions on material defects and defects of title shall apply. All information on goods is information on quality and not a guarantee.
b) less'n'more is only liable for damages caused by less'n'more intentionally or through gross negligence or without regard to the degree of fault through injury to life, body and/or health or without regard to the degree of fault through the breach of cardinal obligations. Cardinal obligations are essential contractual obligations, the proper fulfilment of which is essential for the contractual relationship and on the proper fulfilment of which you as a customer may rely. Liability for the slightly negligent breach of cardinal obligations is limited to typical and foreseeable damage. This limitation of liability also applies to less'n'more's vicarious agents or other persons employed in the performance of its obligations. Claims under the Product Liability Act remain unaffected.
8. retention of title
The ordered products remain our property until full payment has been made.
9 Applicable law
The law of the Federal Republic of Germany shall apply exclusively to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).
10. final provisions
a) The place of jurisdiction and performance shall be the registered office of the seller if the customer is a merchant, a legal entity under public law or a special fund under public law.
b) The contractual language is German.
c) Platform of the European Commission for online dispute resolution (OS) for consumers: http://ec.europa.eu/consumers/odr/. We are not willing and not obliged to participate in a dispute resolution procedure before a consumer arbitration board.
